Terms and Conditions

1. Owner Identification

These terms govern the use of the ReinozArt website (hereinafter, "the website"), operated by:

The website sells original artworks, offers personalised art commissions and lets you enrol in the courses, workshops and activities of the Drawing and Painting Academy (hereinafter, "the products" and "the services").

2. Acceptance and Changes to the Terms

By placing an order, a commission or an enrolment you accept these terms. If you do not agree with any of them, you should not contract through the website.

We may update these terms to reflect changes in the law or in our activity. Each order, commission or enrolment is governed by the version in force at the time it was made.

3. Pre-contractual Information and Formation of the Contract

The presentation of products and services on the website is an invitation to make a request. When you submit the order or commission form you make a purchase request that ReinozArt will review: submitting the form does not involve any charge and does not bind either party. The contract is formed when ReinozArt accepts your order and confirms it by email. ReinozArt may decline an order, in which case it will let you know by the same means.

Before placing your order, you will have the opportunity to review and correct any errors in the data entered. The language of the contract will be Spanish or English, depending on your selection on the website.

4. Prices and Payment

All prices are shown in euros (EUR) and include applicable taxes (VAT) unless otherwise stated. The price of the works in the shop includes shipping anywhere in Spain. Shipping outside Spain is quoted separately: we will confirm its cost and timing before accepting the order, and nothing will be charged without your agreement.

Once your order has been accepted, we will send you the payment instructions and method by email.

Payments for shop orders and commissions placed through the website are processed by Stripe: we do not store card details, and Stripe may require additional authentication (3D Secure) to complete the transaction. If the payment is declined, the order will not be processed. Course fees, workshops and payments at the studio are processed by Square.

The invoice is issued by ReinozArt and sent to you by email. The receipt generated by Stripe or Square is only proof of payment and does not replace the invoice.

5. Delivery and Shipping

The delivery time for each work is shown on its page. If no other time is stated, the maximum is 30 calendar days from acceptance of the order. If for any reason we cannot meet it, we will let you know and you may cancel the order with a full refund of what you paid.

ReinozArt is not liable for delays or incidents caused by force majeure, by incorrect or incomplete delivery details provided by the customer, or by the repeated absence of the recipient.

The risk of loss or damage passes to the customer when they, or the person they have designated, receive the order. If the customer arranges transport with a carrier of their own choice other than those offered by ReinozArt, the risk passes on handing the product to that carrier.

When you receive your order, please check the packaging and let us know as soon as possible, ideally within 48 hours and with photographs, of any visible damage, so that we can claim from the carrier. This does not limit your statutory warranty rights.

6. Right of Withdrawal and Returns

As a consumer, you have 14 calendar days from receipt of the order to withdraw from distance purchases without giving any reason. The details, including the exceptions (personalised works, courses, workshops and activities) and the procedure, are in our Returns Policy.

7. Statutory Warranty

Physical products purchased on this website have a statutory conformity warranty of 2 years from delivery (Directive 2019/771, as transposed into Spanish law through the TRLGDCU). This warranty covers lack of conformity existing at the time of delivery. In the event of a lack of conformity, you are entitled to repair or replacement of the product and, where these are not possible, to a price reduction or termination of the contract.

Original works are handmade: they may show slight differences in colour from how they look on screen and the marks of the handmade process (strokes, textures, irregularities of the paper or canvas). These features are part of the work and do not constitute a lack of conformity.

8. Intellectual Property

All content on the website, including artworks, texts, logos, images and design, is the property of ReinozArt or used with the appropriate authorisation. Reproduction, distribution, modification or public communication without the express consent of its owner is prohibited, except as permitted under intellectual property law (Royal Legislative Decree 1/1996).

Buying an original work or a commission transfers ownership of the physical object, but not the rights to exploit the work (reproduction, distribution, public communication or transformation), which remain with the artist unless agreed otherwise in writing (Art. 56 of the Spanish Intellectual Property Law). You may display the work and photograph it for personal use, but not reproduce it or sell copies.

9. Use of the Website

You agree to:

• Not use the site for unlawful activities or activities contrary to good faith
• Not post offensive, defamatory or discriminatory comments or messages
• Not introduce viruses or any other malicious code
• Not attempt to access restricted areas of the site without authorisation
• Not copy or download images of the works by automated means

10. Third-party Links

This site may contain links to external websites (social media, payment services, messaging). ReinozArt is not responsible for the content, privacy policies or practices of those sites. We recommend reviewing their terms and policies before giving them any personal data.

11. Limitation of Liability

ReinozArt does not guarantee the continuous availability of the website and is not liable for damage arising from:

• Service interruptions due to maintenance, technical failures or force majeure
• Errors or omissions in informational content, which we will correct as soon as we become aware of them
• Misuse of the site by the user

If you contract as a business or professional, ReinozArt's total liability for any claim is limited to the amount paid for the product or service giving rise to it, and excludes loss of profit and indirect damage.

If you contract as a consumer, nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, in particular liability for wilful misconduct or gross negligence, nor your warranty and withdrawal rights.

12. Data Protection

The processing of your personal data is governed by our Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

13. Personalised Commissions

Personalised commissions (portraits, bespoke illustrations, tattoo designs or other work made to your specifications) are requested through the commissions form, choosing one of the published plans or asking for a custom quote. For custom quotes, ReinozArt replies to your request with a quote and work only begins once you accept it.

As the work is made to your specifications, it is not subject to the right of withdrawal (see our Returns Policy). If you ask for the work to begin before the withdrawal period ends, you will be asked to accept this expressly and to acknowledge that you lose that right once work has started.

The style and artistic interpretation are the artist's own: the result may differ from the reference photograph, and that difference is not grounds for a return. Changes you request to what was agreed may involve an additional cost, which we will tell you before making them.

Tattoo designs are supplied for you to have tattooed once; they may not be resold or passed on to third parties. ReinozArt may show commissions in its portfolio, website and social media unless you ask us in writing not to.

Any reference images you attach must be your own or used with their owners' permission, and you warrant that you are entitled to use them for the commission.

14. Academy Courses, Workshops and Activities

Enrolment. The ReinozArt Drawing and Painting Academy runs in-person classes in groups with limited places per time slot. Enrolling through the website is a request subject to availability and to our confirmation; it does not guarantee a place until you receive it. Free open days and activities are likewise subject to limited places on a first-come basis. Minors must be enrolled by their parent or legal guardian, who is responsible for the information provided.

Prices and fees. The prices, timetables and conditions of each course are those published on its page. Monthly fees are charged on a recurring basis through Square, which gives you access to a customer portal where you can see your payments. There is no minimum commitment.

Cancellations and changes. To cancel, change time slot or change your fee, write to us at reine@reinoz.art before the next payment date. Cancellation takes effect from the next period; the fee for the current period is not refunded. Classes the student misses for reasons not attributable to ReinozArt are not refunded; where there is a free place in another group, we may offer to make them up.

Cancellations on our side. If ReinozArt cancels a class or activity, we will offer to make it up on another date or, if that is not possible, refund the proportional part of what you paid.

Right of withdrawal. Courses, workshops, birthday parties and other activities are in-person leisure services provided at a specific place and on specific dates or times, so the right of withdrawal does not apply to them (Art. 103(l) TRLGDCU). In addition, enrolments and payments made at the studio itself are not distance contracts. In any case, should the right be deemed to apply, by asking for classes to start within 14 days of contracting you expressly agree that only the classes not yet received will be refunded (Art. 108(3) TRLGDCU).

During classes. We work with paints and materials that can stain: we recommend suitable clothing. Students under 18 are under the studio's supervision only during their class time; please be punctual at drop-off and pick-up.

Students' work. Work made in class belongs to its author. By enrolling, or enrolling a minor, you authorise ReinozArt, free of charge, to photograph that work and show it on its website and social media, without the student's name. You can withdraw this authorisation at any time by writing to reine@reinoz.art. We do not publish photographs in which a student can be recognised without their express written permission or, for a minor, that of their parent or legal guardian.

15. Applicable Law, Complaints and Jurisdiction

These terms are governed by Spanish law. If you contract as a consumer, disputes will be submitted to the courts of your place of residence. If you contract as a business or professional, to the courts of A Coruña.
